    Actual thing said to me at a performance review yesterday- swiftly followed by my boss telling me to "clock out whenever you're not actively working." Is this legal?????

  • Caelarch This isn't really an "engaged to wait" issue. OP's boss is failing to understand the continuous workday rule. Engaged to wait is for folks like firefighters or emts that are paid to be immediately available. Not for ordinary work breaks during the day.

  • cryssHappy Also look up FLSA - Fair Labor Standards Act - which mean if boss has no work for you for 10 minutes, that's on the boss. With a boss like that, I'd be looking for a different job.

  • Zestyclose-Lead-4872 Don't ever clock out under this set of circumstances. It is patently illegal. If there is any adverse action taken by him as a result of this demand, find a good labor lawyer and pounce. Hopefully, your employer has deep pockets.
